Please read these Terms of Use ("Terms", "Terms of Use") carefully before using the Sparky: Energy & Mood Tracker mobile application (the "Service") operated by Kiryl Kalatski ("us", "we", or "our").

By downloading or using the app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app.

1. Acknowledgement

These Terms are concluded between you and us only, and not with Apple. We are solely responsible for the Service and the content thereof.

2. Medical Disclaimer

Sparky is not a medical device. The Service is provided for informational and self-reflection purposes only. It is not intended to diagnose, treat, cure, or prevent any disease or health condition. If you have concerns about your health, energy levels, or mental well-being, please consult a qualified healthcare professional.

3. Subscriptions and Payments

Sparky offers auto-renewing subscriptions to access premium features ("Sparky PRO").

Payment: Payment will be charged to your Apple ID account at the confirmation of purchase.
Automatic Renewal: Subscription automatically renews unless it is canceled at least 24 hours before the end of the current period.
Account Charging: Your account will be charged for renewal within 24 hours prior to the end of the current period.
Management: You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.
Free Trial: Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication, where applicable.

4. Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Kiryl Kalatski and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.
